Terms and Conditions:

 

1. These terms and conditions govern the Mexicali Fresh Cabana Club Card program.

(a) Your use of the Mexicali Fresh Cabana Club Card confirms your agreement to these terms and conditions as may be varied from time to time.

(b)  You must comply with these terms and conditions.

 

2. Definitions

In these terms and conditions:

 "Mexicali Fresh Cabana Club Card"  means:  The individually identifiable Card  issued by Mexicali Fresh by which discounts can be earned and redeemed.

 "Points"  means:  Points credited by Mexicali Fresh to your  Mexicali Fresh Cabana Club Card.

 "Privacy Policy"  means:  The Privacy Policy set out on the  website.

 "Website"  means:  The Mexicali Fresh website at www.Mexicalifresh.co.nz.

 

3. Participation

(a)   To participate in the Mexicali Fresh Cabana Club Card program you must obtain a Mexicali Fresh CABANA CLUB Card from a participating Mexicali Fresh store. Only individuals may participate in the Mexicali Fresh Cabana Club Card program. You may not transfer your Mexicali Fresh Cabana Club Card to another individual.

(b)  You must register and activate your Mexicali Fresh Cabana Club Card online at the website prior to being able to redeem points.

(c)  Your Mexicali Fresh Cabana Club Card and use of it is free of charge except where a replacement is issued to you at your request. The cost of that replacement will be 50 points from your account balance.

 

4.  Personal Information about You

(a)  Personal information about you may be collected and held on behalf of Mexicali Fresh in accordance with the Privacy Policy. Any information collected and held may be

used from time to time to administer the Mexicali Fresh Cabana Club Card program, provide you with services, for marketing and promotional purposes and for other reasons set out in the Privacy Policy. Under the Privacy Act 1993, you have rights of access to, and correction of, any personal information held by us.

(b) If you have provided us with an email address or a text number, you agree that we may send you emails or text messages for any of the purposes set out in clause 4(a) above or the Privacy Policy.

 

5. Lost Card

If the Mexicali Fresh Cabana Club Card is lost or stolen you must immediately deactivate your use of the card by notifying us so that we can do so on your behalf. To replace the lost or stolen Mexicali Fresh CABANA CLUB

Card you need to:

(a)  Obtain a new Mexicali Fresh Cabana Club Card from one of our participating stores at a cost of 100 points.

(b)   Register your replacement Mexicali Fresh Cabana Club Card details online via your Mexicali Fresh Cabana Club Card account.

(c)    We are not responsible for any loss to you arising in relation to a lost or stolen

Mexicali Fresh Cabana Club Card and accordingly we cannot guarantee that all Points earned prior to the date of loss or theft of the Card will be available for use on your replacement Mexicali Fresh Card.

 

6.  CABANA CLUB Card Points

(a)  To earn Points you must notify the participating store before the transaction is concluded that the transaction is a Mexicali Fresh Cabana Club Card transaction. This must be done by presenting your Mexicali Fresh Cabana Club Card at the time of purchase. Points may not be earned or redeemed when processed via the online ordering system.

(b)  Points earned by you will be added to your account after a transaction has been completed.

(c)  Points may only be earned on products outlined in the Points Schedule. Points may not be earned on redemption transactions.

 

7. Redeeming Points

(a)  Once you have registered and activated your Mexicali Fresh Cabana Club Card online at the website and achieved a minimum Points balance of 100 you will be eligible to redeem those Points by presenting your Mexicali Fresh Cabana Club Card at a participating Mexicali Fresh store.

(b) When redemption takes place it will take place in respect of all the Points held to the credit of a Card. There is no ability to partially redeem Points.

(c) Points may only be redeemed on products outlined in the Points Schedule from participating Mexicali Fresh stores.

(d) You may redeem one product per transaction only.

(e) You must always have a minimum of 10 points on your Mexicali Fresh Cabana Club Card in order to redeem points.

 

8. Point Balances

(a) The balance of points held to the credit of your Mexicali Fresh Cabana Club Card can be checked at any time in a participating Mexicali Fresh store or on the Website.

 

9.  Expiry of Points

(a)  Points expire 12 months after the date on which the points were earned.

 

10.  Liability

We are not liable for:

(a) A delay in supplying a replacement Mexicali Fresh Cabana Club Card;

(b) Unauthorised use of your Mexicali Fresh Cabana Club Card;

(c) Failure by you to notify a participating store that a purchase is a Mexicali Fresh Cabana Club Card transaction;

(d) Failure to notify you of any changes to these terms and conditions;

(e) Any error, misstatement or omission in the information and content contained on the

Website;

(f) Claim arising from or relating to termination of the Mexicali Fresh Cabana Club Card program.

 

11. Termination

(a) We reserve the right to suspend or terminate the Mexicali Fresh Cabana Club Card program at any time in our sole discretion without prior notice.

(b)  In addition to our right to terminate or suspend the Mexicali Fresh Cabana Club Card program at any time, we may terminate your Mexicali Fresh Cabana Club Card account at any time without prior notice should:

(i)   You fail to comply with these terms and conditions; or

(ii)  Your Mexicali Fresh Cabana Club Card is not used for a period of 6 months;

(c)  Upon termination of your Mexicali Fresh Cabana Club Card you will not be able to redeem any Points which might otherwise have been available to you.
